Terms of purchase

The terms of purchase define the process of ordering, payment, delivery, rejection, and complaints of goods available in our online store. The supplier (seller) is Polleo Adria d.o.o. The buyer of the goods is a visitor to the online store who selects at least one product, adds it to the shopping cart, and pays by credit card, via e-banking, by bank transfer (post office, bank, etc.), or sends the order and pays for the product upon delivery (cash or card).

Through the online store www.polleosport.si, customers can purchase all products available on the seller's website.

Prices include VAT.

The currency is Euro (EUR).

Polleo Adria d.o.o, Samoborska cesta 134, 10000 Zagreb, OIB 12791380945 is the owner of the website www.polleosport.si.

Ordering

Ordering goods is possible 24 hours a day, 7 days a week. Goods are ordered via an electronic form or by phone at the phone number 068 671 428. If the seller cannot deliver all ordered items, only those available will be delivered, and the customer will be informed about the delivery. The customer can accept or cancel the delivery of the goods. If the customer does not have an email address, they will be informed by phone.

Conclusion of Contract

All orders you place will be treated as an offer to purchase goods or services from us, and we reserve the right to reject such offers at any time. You agree that any automatic acknowledgment of your order that you may receive from us will not constitute our acceptance of your offer to purchase goods or services advertised on the website. The contract will be concluded when we ship the goods and send an email with shipment confirmation. The contract will only apply to those products or services whose shipments we have confirmed. We will not be obliged to deliver any other goods or services that were part of your order until confirmed in a separate shipment confirmation.

The display of goods in the online store is not a legally binding offer, but only a non-binding online catalog. By clicking the "Order" button, you submit a binding order for the goods in the shopping cart. The order confirmation is issued immediately after the order is sent and does not constitute acceptance of the contract.

The store sends a confirmation of acceptance or rejection of the buyer's offer, submitted in electronic form ("Order Execution and Delivery Confirmation") to the email address provided by the buyer. Upon receipt of the aforementioned confirmation, a contract of purchase and sale of the products ordered by the buyer is concluded between the customer and Polleo Sport.

Ordered products with delivery costs (if applicable) are paid by credit card, in cash upon delivery, or by online payment on the seller's website through the WS Payment Gateway with American Express, Diners, Visa, or Maestro and MasterCard cards. In the event that you order goods and reject them, the seller has the right to demand compensation from the buyer for incurred postal and handling costs.

In the event of incorrectly marked product prices, we are not obligated to deliver the product at the stated, incorrect price if we have notified you before sending the said product. In such circumstances, we reserve the right to cancel your order. If your order is canceled, we will refund the full amount paid, including any costs, and provide an additional gift as an apology.

Payment in cryptocurrencies is enabled in cooperation with the company Electrocoin through their PayCek platform, a payment service for processing cryptocurrency payments.

PayCek allows easy, secure, and fast payment with cryptocurrencies.

In our online store, it is possible to pay with several different cryptocurrencies - Bitcoin (BTC), Ethereum (ETH), Stellar (XLM), Ripple (XRP), Tether (USDT), USDC, Bitcoin Cash (BCH), DAI, Binance USD (BUSD), Solana (SOL), and EOS.

What is the payment process via PayCek in the Polleo Sport online store?

The payment process with cryptocurrencies is simple and very similar to card payments.

  • You come to the checkout of the Polleo Sport online store where you need to select "Payment Method"
  • In addition to the current payment methods (cash on delivery, via online banking, credit card, PayPal, etc.), a new option "PayCek - Payment with cryptocurrency" is added
  • Here you select payment with cryptocurrency as the payment method
  • After clicking "Review order" and when you click "Confirm order", a new field PayCek opens, where you select the cryptocurrency with which you want to pay for the order
  • When you select the currency and press the "Confirm" button, a QR code appears where you have 15 minutes to complete the transaction
  • You scan the QR code with your digital wallet on your mobile phone
  • If you have made the payment, a green checkmark will appear, indicating that the payment has been successfully completed.
  • The system will then automatically return you to the online store or you can return yourself by clicking "Back to the store".

 

Notes:

In case of cancellation or refund, the buyer will be refunded in euros to their account.

Polleo Sport allows payments in cryptocurrencies but receives funds in euros to the bank account. If the customer decides for a refund, it will be done directly from our bank account to the customer's account in EUR.

The minimum transaction amount is €0.01, and the maximum transaction amount is the limit prescribed by applicable laws for processing the transaction.

The speed of transaction processing depends on the speed of processing the blockchain protocol of the selected currency. In practice, payments in Bitcoin, Ether, Dai, USDC, USDT, and Bitcoin Cash take at least a few minutes, but can also take up to 10 minutes, which affects the payment experience. At the same time, payments in Stellar, XRP (Ripple), and EOS currencies will be processed in 30 seconds.

Payment for purchases of heavy goods, whose weight exceeds 31 kg, must be made in advance through electronic payment methods available on our website. We do not allow cash payment upon receipt of such goods.

Returns and Complaints

These terms, as well as the terms of sale for individuals, provided as information about certain products, represent the offer of Polleo Adria for the conclusion of an agreement between the user as a buyer with their registration, by completing the order, or in any other way specified in this agreement between the user and Polleo Adria (Polleo Sport), and with the terms of sale specified in these conditions.

The subject and commercial purpose of the agreement is the purchase of selected products or services through the Polleo Sport online store in exchange for payment – the price for this product or service. The contract is concluded through distance contracts (contracts concluded at a distance), using printed messages with an order form, phone with human intervention or without it, and the internet.

The agreement becomes effective and binding from the moment the customer accepts the offer of Polleo Adria in one of the following ways:

· Choosing and completing payment orders as a registered user of Polleo Sport,

· Choosing and completing payment orders as a guest user of Polleo Sports,

· Choosing payment and completing the order via telephone line.

a) In the registration process or creating a user account, the user must choose a name or business name under which they will perform the service, choose a security password, and provide a valid email address. All data required for registration or account creation must be true, and it is prohibited to use the data of other people.

b) Registration or user account can only be created for one person, and it is not allowed to disclose registration or account information to third parties. The user is obliged to keep information about their security passwords and accounts. This should not be used for the registration or account of someone else.

c) For a violation of the provisions of the terms of this chapter, Polleo Adria reserves the right, at its discretion, to terminate registration or user accounts without any obligation to any costs or damages.

d) With registration (including payment services), it is considered that an agreement has been concluded between Polleo Adria and the user as a buyer.

e) The agreement comes into force when user registration is completed, or from the day the user accepts the conclusion of such an agreement.

f) Upon conclusion of the agreement, the user accepts: confirmation of the concluded contract or pre-contractual information from Article 57 of the Consumer Protection Act (Official Gazette of the RS, No. 41/2014), these conditions, and information about the rights of users to unilaterally terminate the contract with a form for unilateral termination of this agreement in accordance with Article 61, paragraphs 1 and 2 of the Consumer Protection Act.

g) The user can unilaterally terminate the contract within 14 (fourteen) days without giving any reason. The user does not have the right to unilaterally terminate the contract:

- If the service has been fully completed, and performance has begun with the explicit prior consent and confirmation that they are aware that they will lose the right to unilaterally terminate the contract if their service is fully completed,

- If the subject of the agreement is sealed goods that are not suitable for return for health or hygiene reasons if they have been opened after delivery,

- If the subject of the contract is goods which, by their nature, are inseparably mixed with other goods after delivery,

- If the subject of the contract is the delivery of sealed audio or video recordings or computer programs which have been unsealed after delivery, and

- If the subject of the contract is the delivery of newspapers, journals, or periodicals, with the exception of subscription contracts for such publications.

In order to enable the user to exercise the right to unilaterally terminate the contract, they must inform Polleo Adria of their decision to unilaterally terminate the contract before the expiry of the deadline and make an unequivocal statement by mail (to Polleo Adria d.o.o., Samoborska cesta 134, Zagreb), by fax at 01/3692 484, or by email to shop@polleosport.si, stating their name, address, telephone, fax, or email address, and can be used in the form provided for unilateral termination of this agreement.

The form for unilateral termination of this agreement can be found here, and can be completed and submitted electronically. In this case, Polleo Adria immediately submits a notice of receipt of unilateral termination of the contract by email.

The deadline for unilateral termination of the contract is 14 (fourteen) days from the day when the user or a third party designated by the user, who is not the carrier, takes possession of the goods subject to this agreement, or in the case of a service, from the conclusion of the contract.

If the user unilaterally terminates the contract, the money received from them will be refunded, including delivery costs, without delay and no later than fourteen (14) days from the day Polleo Adria or Polleo Sport receives the user's decision to unilaterally terminate the contract, if the user has chosen a different delivery method than the cheapest standard delivery available. The funds will be refunded to the bank account provided to us by the user via our email address. If the user agrees otherwise, the amount paid will be refunded, and they will not incur any costs related to the refund. Polleo Adria can only refund the money once the goods have been returned, or after proof has been submitted that the goods have been sent back.

The user is obliged to deliver the goods or send them to the address of Polleo Adria (Polleo Sport), Samoborska 134, 10000 Zagreb, Croatia, without undue delay and in any case no later than fourteen (14) days from the date Polleo Adria or Polleo Sport addressed their decision to unilaterally terminate the agreement. The direct cost of returning the goods is covered by the user. Users are kindly requested to notify the termination of the agreement by phone or email to shop@polleosport.si, to be informed of the return process.

The user is responsible for any decrease in the value of the goods resulting from handling the goods, except if it was necessary for the characteristics and functionality of the goods.

If the user requests the performance of a service after the start of the period for unilateral termination of the contract, the buyer must pay Polleo Adria an amount proportionate to what has been provided since the user notified Polleo Adria of the unilateral termination.

In case of material defects, the seller is responsible for all material defects of the goods sold on its website in accordance with applicable regulations, especially with the laws on contractual relationships of the Republic of Slovenia.

In the event of obvious damage to the products in the shipment (e.g., damage to the packaging), the buyer is not required to accept the product and can reject it, and is not responsible for the delivery costs of such products. It is considered that the products accepted by the customers were free of visible damages.

If a product has a hidden defect (e.g., a defective product, scratched product caused by transportation or improper storage) that the buyer discovers upon opening the product without use, installation, or insertion of the product to start working, as determined by an authorized service - the buyer has the right to unilaterally terminate the contract and receive compensation for replacement of the product, defect correction, or price reduction.

Products for which we provide warranties in accordance with the law and warranties specified by the manufacturer have a warranty card. The right to use the warranty is possible together with the invoice. The buyer must keep the warranty card and invoice. The date of issuance of the invoice is the start of the activation of the warranties. The description of the products contains information on the duration of the warranty for a particular product.

In the case of issuing a warranty card guaranteeing the operation of the products within a specified period, if the product does not work properly, the buyer can have the product repaired or replaced within a reasonable time frame. If the same defect reappears on the product during the warranty period, it should be delivered to an authorized service center specified in the warranty.

The right to use the warranty is realized only in this way. The buyer must keep the warranty card and invoice. A product defect due to improper use and/or inability to comply with the instructions is not covered by the warranty. Service and sale of spare parts for the purchased product are provided by the authorized service center specified in the warranty.

If you purchase goods in Polleo Sport stores, according to EU rules, you are not entitled to a refund (cash refund) unless the product is damaged. However, if the product is technically sound and meets all the above return conditions, we can approve a replacement for another product of equal or greater value. Exchange of socks and underwear for hygiene reasons is not possible. Exchange of swimwear is possible only with the original label, inner label, and protective film.

We inform you that with the new method of implementing online payments, concerns about the security of your credit card data are completely unnecessary. The new online payment system allows credit card data to be entered exclusively on secure bank pages. We, as a merchant, do not have access to or insight into this data. If you choose to pay by credit card, you will be redirected to secure web pages managed by the WSpay™ system with which we have a contract.

Delivery

Delivery Terms

Delivery of goods is carried out with express delivery within 3 working days. If the products are immediately available for delivery, delivery can be possible within 48 hours of receiving the order. The user will be informed about the delivery method when ordering goods (electronically or by phone, depending on the purchase chosen by the customer). If the goods are not available, the seller will inform the buyer (in writing or by phone) about the possibility of delivery. The buyer can then accept a new delivery date or cancel the order. If the buyer decides to cancel the order, the seller will refund the money no later than 30 days from the moment of delay, plus late payment interest. The buyer is obliged to check for any damage upon receiving the goods and immediately report it to the delivery person who provided the delivery, or reject accepting the package if damages are visible.

Other Delivery Terms

Products are packaged in a way that they cannot be damaged during normal handling in transit. The buyer is required to check the product for any damage upon receipt and demand from the delivery person who provided the goods to reject accepting the package if damages are visible. Products are insured against loss during delivery.

Shipping Cost

Shipping for orders less than EUR 39.99 is EUR 3.99, while shipping is free for orders over EUR 39.99. For orders over EUR 39.99, the buyer can choose one of the offered gifts as compensation for free delivery.
For orders over EUR 39.99, only one of the offered options can be realized; free delivery or gift. Choosing both options and realizing them is not possible.

Cargo delivery - Delivery of Heavy Items

Shipments exceeding 35 kg or classified as oversized items are delivered via Cargo delivery. When selecting such items, customers will automatically see only the Cargo delivery option in the cart. The delivery fee is 10 € per order, with no exceptions, and cash on delivery is not available for this type of delivery.

Pickup at the Store

Delivery to the store is completely free for all orders. For orders over EUR 39.99 with pickup at the store, the customer automatically receives free delivery, while the option to exchange delivery for a gift is not possible as with delivery to the address.

Delivery to Parcel Locker - GLS Slovenia:*

Shipping for orders with a value less than EUR 39.99 is EUR 3.99, while shipping is free for orders over EUR 39.99. For orders with a value of more than EUR 39.99, the customer can choose one of the offered gifts instead of free delivery.

For orders over EUR 39.99, only one of the offered options can be used; free delivery or gift. Choosing both options and their enforcement is not possible.

*Parcel lockers cannot accept shipments heavier than 20 kg (depending on the delivery service) or orders sent in multiple parts. The option of delivery to a parcel locker will be displayed only if the contents of the shopping cart meet the necessary conditions.*

Priority Order

  • We guarantee priority processing of the order and shipment on the same or no later than the next working day after receiving the order

  • If you have chosen pickup at the store, we guarantee that the order will be ready for pickup on the same or the first next working day.

  • The option of choosing priority processing of the order applies only to items that are in stock

  • An order marked "priority" is processed in our warehouse within the next 1-2 hours, before "regular" orders

  • It is also possible to pay by invoice (upon offer/pre-invoice), which you will receive at your email address after completing the order. Upon receipt of payment, the order proceeds to further processing in priority. However, with this payment method, the processing and delivery process may be extended by 1-2 working days, depending on when we receive the payment to our account.

  • After placing the order, changing the payment and delivery method is no longer possible.

  • In case of choosing priority processing of the order, the delivery cost is increased by EUR 3.99.

  • Priority order does not guarantee delivery on the desired date/day. We will prioritize processing the order and deliver it as soon as possible with the selected delivery service.

 

Ensuring Privacy

We guarantee the security and confidentiality of all customer data. Information must be complete and credible. We are committed to protecting the privacy and confidentiality of personal data of all our customers, in accordance with the Personal Data Protection Act, Official Gazette of the Republic of Slovenia, No. 103/2003 and 118/2006. We only collect necessary basic information about customers/users and inform our customers about how we use them. We regularly offer our customers a choice regarding data collection, including the decision if they want their name to be removed from the list used for marketing campaigns. The Polleo Sport website guarantees that the personal data of users of the online store will never be made available to third parties without the prior express consent of the user. Therefore, access by authorized services of executive state authorities of the Republic of Slovenia for the purposes of investigative measures, in accordance with valid court decisions, is exempt.

Return

Returns will be processed using the same payment method you used for the original payment, unless we agree otherwise explicitly. We will not charge you any fees for the return. The execution of the return may be delayed until we receive the goods back or until you provide us with evidence that you have returned the goods, depending on which occurs earlier.

The verifiability statement is an integral part of the purchase terms.

Changes

Polleo Sport web reserves the right to change these terms and undertakes to inform all registered users via the email address they provided during registration. If you do not agree with the rules of use and do not want to accept them, please contact our contacts with your explanations and refrain from using the online store services during this time.
